Justiciable Controversey

Closely related to and subsumed within the legal concept of 'standing to sue' (a sufficient stake in a matter to justify seeking relief through the court system; viz., a party must have a legally protected and tangible interest at stake in the litigation in order to have standing; that is, said party must have suffered a harm/injury or been threatened with harm/injury), a justiciable controversy is one that is real and substantial, as opposed to hypothetical or academic. Justiciable Controversy is defined in Ballentine's Law Dictionary thusly: 'A controversy appropriate for judicial inquiry or adjudgment. 20 Am J2d Cts §80. A controversy not so exclusively or predominantly involved with political questions as to come within the perogative of the legislative or administrative branch of government. Chicago & Southern Airlines v. Waterman SS Corp., 333 U.S. 103, 92 L.Ed. 568, 68 S.Ct. 431. For the purposes of declaratory relief:- a controversy involving more than a mere difference of opinion; a controversy involving persons adversely interested in matters in respect of which a declaration is sought. 22 Am J2d Dec J § 11.'

Religious Expression

The inquiry falling within the ambit of law broadly referred to as constitutional law, the First Amendment states that the government may neither establish any religion nor prohibit the free exercise of religious practices. The first part of the foregoing constitutional provision is referred to as the ‘establishment clause’ which has to do with the separation of church and state; while the second part is referred to as the ’free exercise clause'. Religion has been broadly defined by the U.S. Supreme Court and other courts as, ’A belief had or sought by man to explain the meaning of his existence. A person’s understanding of his relation to the Creator and of obligations of reverence and obedience imposed by such relation. Also, some system of faith and practice, predicated upon the idea of one God, the Creator and Ruler, to whom his creatures owe obedience and love. Another view is the belief in the existence of superior beings exercising power over human beings by volition, and imposing rules of conduct, with future re-wards and punishments. And still more encompassing, as all the different systems of faith and worship to be found in the world.’ [Citations Omitted]. Expression is (briefly) defined (noun) as an utterance, something that represents or symbolizes, and (verb) as make known, show, state, etc.. Expression (noun/verb) of or relating to religion is afforded protection under the Constitution, and the same shall not be abridged thereunder. The notion of Free Speech (1st Amendment) may also be referenced in the protection of religious expression.

CA'S ANTI-SMOKING ADS

At the outset, I should state that I do smoke tobacco which for whatever reason (given the death, carnage, crime, corruption, etc. attendant to alcohol and illegal drugs) has been the object of California's substantial attention despite the pervasiveness of and the state's blasé attitude toward illegal drugs [I have seen los angelians shooting up (main-lining, probably heroin) on the streets of LA in broad daylight,"curbside", and unobstructed, as well as smoking crack]. Parenthetically, I ask any California "policymaker" to tell me the last time they had heard of someone robbing another or committing other crime to get money for a pack of cigarettes which admittedly are not healthy but do not impair ones mental acuity. (Also, see the Reuters article which follows and which, along with increasing crime rates, should be more worthy of California's time, money (on top of huge deficits), and attention). Having said that, I also vigorously support the advertising campaign designed to inform the citizenry of the detriments of tobacco, particularly as to children (less than 18 and/or 21) (though not the "knee-jerk tax overload"). Indeed, one could not (successfully) argue that the potentially salutary (health) effects eminating from an informed citizenry on the issue, particularly as to children, was not a compelling state interest. While not directly on point, the case of Stanson v. Mott set forth the principle that the dissemination to the public be a fair presentation of the facts. Neither the Hatch Act, nor the Bellotti, City of Boston, and Association of Letter Carriers cases are apposite and germane to scrutinizing the subject issue. The "Toxic Beginnings" study divided California into five geographical areas. It concluded that in Los Angeles an infant would have reached the EPA's one chance in one million limit of contracting cancer from contaminants in 12 days, and in Sacramento it would take 23 days. It said diesel exhaust -- from trucks and cars, school buses, and farm and construction equipment -- was still the worst source of air pollution. But it also took into account chemicals emitted by dry cleaners and factories as well as pesticides, adhesives and lubricant oils. The National Environmental Trust urged federal and state policy makers to make cleaning up the air a priority. "The overwhelming policy implication of these findings can be reduced to one word: URGENCY," it said. It recommended that regional and local governments emphasize alternative technologies and fuels, replace diesel school buses and other municipal vehicles with cleaner alternative fuel models and enforce existing laws on fuel emissions.

A propaganda machine of enormous proportion with controlled media, the U.S. has employed such historic fictions as the doctrine of "manifest destiny", etc., to rationalize America's illegitimacy and illegal acts. Indeed, for example, the recent bombing and murder of innocent civilians with cruise missiles (of ie., aspirin factories) of other nations to divert attention from the numerous personal crimes of America's (reknown despite corrupt coverup) criminal leader Clinton, typifies America's willingness to violate any notion of law to avoid detection, exposure, truth, and justice. ‘TV in(on) demand and 1st Amendment’

One may personally become an arbiter of what is “obscene” in the u.s. supreme court tradition by employing their “astute” and historically “sound” judicial reasoning and principle underpinning their “famed” observation, “you know it when you see it”. In light of the lack of meaningful rule(s) of law and cover-ups of substantial illegal acts by no less than their employer, the u.s. government among others, in america today as has been so for quite some time, one could readily and correctly conclude that they (the u.s. supreme court – along with their partners in crimes/appeals and district courts) are obscene; that is, ‘utterly without redeeming social value’. 1. I am the pro se plaintiff in the present matter and if called upon to testify I could and would competently testify (truthfully) to the following facts of my own personal knowledge.

2. A review of the Court record underlying defendant Dearenosa’s crime of perjury would reveal that defendant DeArenosa did not attend even one status conference which also, by way of plaintiff’s “status filing” therein would have set forth the fact of defendant Ojeda’s default,in addition to the fact of defendant DeArenosa’s receipt of Plaintiff’s Request to Default Judgment along with accompanying Declaration in Support thereof and the Entry of Default as set forth herein. Defendants Ojeda and DeArenosa are inveterate liars.

3. In the aforesaid matter underlying defendant De-Arenosa’s crime of perjury, he had previously been sanctioned by the Court for failing to appear and respondto a prior Order to Show Cause.

4. In the instant case, defendant DeArenosa offered no response to the Order to Show Cause in his “Answer”(sic) and upon being queried by the Court as to whether he understood what having his answer striken meant, he, defendant DeArenosa responded affirmatively, “yes”, without either objection or further discussion (despite being accorded the opportunity for same at that time – probably, and I am inferring beyond the scope of this declaration/certification and not a part hereof, thankful for the Court’s mercy in not having him arrested for his crime of perjury).

5. Defendant DeArenosa should be criminally prosecuted for his crime of perjury and disbarred.

6. In light of the foregoing, in the practical interest of very busy courts, sound judicial economy and credibility in the process, and in the paramount judicial interests of truth and justice, defendant DeArenosa’s Motion for Reconsideration should be DENIED, and a criminal referral of his clear crime of perjury should issue forthwith.

Defamation

‘A communication is defamatory if it tends so to harm the reputation of another as to lower him in the estimation of the community or to deter third persons from associating or dealing with him.’ Restatement,Torts 2nd . ‘The publication of anything which is injurious to the good name or reputation of another person, which tends to bring him into disrepute’……’Words which produce any perceptible injury to the reputation of another; a false publication likely to bring another in disrepute’………’A publication is defamatory when it tends to injure one’s reputation in the community and to expose him tohatred, ridicule, scorn, and contempt’. [Citationsomitted]. TRUTH is almost without exception (there are some very narrow exceptions beyond the scope of this writing) an absolute defense to a cause of action sounding in defamation. The recent defamation case involving Tom Cruise is interesting if only by the paucity of information (advance sheets, filings, etc.; I assume the same were sealed) surrounding a judgment entered in his favor in the amount of $10,000,000 (by default?/summaryadjudication?; a judgment is a judgment none-the-less). An actor is exactly that; viz., an actor. That Rock Hudson successfully portrayed virile, heterosexual men while in actuality being a homosexual, is a testament to the “power” of the cinematic medium and/or the actor’s ability. As a heterosexual male I personally give Tom Cruise great credit for having accomplished anything during his marriage to Nicole Kidman inasmuch as I or any other male would probably dissipate all time and energy either having sex with her, or thinking about having sex with her (a “hot number”). His former wife, Mimi Rodgers likened her own “sexuality” to a “musical instrument that needed tuning”, without accommodationby Cruise. Das Speagle magazine printed, that he(Cruise) was “a sterile man with a low sperm count”. If San Francisco, CA., were his only community, his cause of action probably would not lie. However, as a top-shelf, world-class actor his “community” is more than one city.

Media Filters During War: It is appropriate that a rule of reason be appliedwhere, in particular, the lives and well being ofsoldiers are on the line. Appropriately, a similarstandard is apposite where national security isimpacted (adversely). Specifically, though in thecontext of what has been referred to as a "cold war",in the case of United States v. Progressive, Inc., thecourt in granting the government's request for a preliminary injunction, held that the government hadmet the test previously enunciated in the New YorkTimes case; viz., that (in publication of certainportions of the article dealing with the mechanics ofan H-bomb) there existed a grave, direct, immediateand irreparable harm to the United States, furtherexpounding in pertinent part as follows: ".....What isinvolved here is information dealing with the mostdestructive weapon in the history of mankind,information of sufficient destructive potential tonullify the right to free speech and to endanger theright to life itself." Indeed, similar rationale has been applied and hasunderpinned controls on media access to actualmilitary operations. Consistent with (thankfully) theinclination of the judicial branch to defer to thejudgment of military experts on matters pertaining toactual conduct of an ongoing war, it is inferred thatthe Court would uphold restrictions on media access tomilitary operations as they have in other governmentcontrolled settings including prisons and militarybases.


Jurisdiction Over the Internet

It has been noted by commentators/authors that defining, establishing, and asserting jurisdiction are much more difficult in cyberspace than in the so called physical world inasmuch as, to restate the obvious, there is an absence of physical boundaries. Indeed, by way of illustration, the server for a particular company may be in one country, employees who access the server remotely in another, factories producing and/or distributing the products in yet other countries, and consumers buying and/or affected by the products virtually worldwide. The notion of subject matter jurisdiction still operates within the same parameters; viz., federal courts having jurisdiction over issues governed by federal law (ie., bankruptcy, RICO, copyrite, patent, federal taxation, with exceptions for ancillary/pendant jurisdiction) and state courts having jurisdiction over issues governed by state law (ie., professional licensing, state tax, do-mestic). Personal jurisdiction is more problematic. Indeed, long-arm statutes still would be apposite, particularly for some torts more than others. In the sphere of contract law, it is a wise draftsman who would incorporate a forum selection clause in whatever cyber commerce/trans-action/contract he or she is involved in. In fact, I believe the same to be, from my own perspective, a wise addition to even a terms of service agreement as typically found on the web.



WGA Contracts

The Writers Guild of America (WGA) promulgates what is sometimes referred to as the WGA Agreement, WGA Contract, Minimum Basic Agreement, or MBA and constitutes what a member of said organization should expect in valuable (contractual) protections automatically by virtue of said membership. The Guild protections are minimum protections which can be enhanced contractually through negotiation. It should be noted that the aforesaid should be distinguished from, and is not apposite to a scenario in which the writer produces what is referred to as a ‘work made for hire’, most likely in the context of a contractual agreement governing same, and/or employment relation-ship/agreement (wherein it is likely that the employer retains the rights to said work; ie., script, screenplay, etc.). A fairly recent addition to the Writers Guild Agreement was Article 49 which prohibits the submission of scripts without an option/purchase agreement in place or without specific permission. In an option/purchase agreement, the option price is the amount the producer pays to gain exclusive control over a particular piece of material (ie., script, screenplay, novel, etc.). The option will be for a particular duration, at the end of which period of time the producer must either “exercise” his option (purchase the rights by paying the purchase price – usually at time of exercise although that may vary) or lose the right to buy rights in the material. The rights the writer sells are the rights granted while those retained by the writer are the rights reserved. Reserved rights typically include stage rights, ‘live’ television rights, and radio rights. Some screenwriters may negotiate novelization rights. Book authors reserve the right to create author-written sequels/prequels with studios usually reserving a right of first negotiation/last refusal to buy the motion picture rights to such sequels. Representations and warranties are also set forth with the Guild insisting (via Article 28) that any warranties concerning material which may be based on actual persons be only “to the best of the writer’s knowledge".

Scriptwriter’s Protection

As pertains to the subject matter, ‘Creative Property’, it should be preliminarily noted that U.S. Copyright Law and the protection afforded thereunder derives from Article I, Section 8, of the U.S. Constitution which sets forth in pertinent part: ‘The Congress shall have the power ……………… to promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.’ It should be further noted in accordance therewith that if the work is an original creation, then it is automati-cally protected under copyright law. “Copyright protection subsists …………. in original works of authorship fixed in the tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device.” Pursuant to the current copyright act (as distinguished from the old act(1909)), no formalities are required and one owns a copyright in one’s work when it is written. The literary (or artistic) works must be original and fixed in a durable medium that can be perceived, repro-duced, or communicated. Importantly, an exception to the foregoing includes what is referred to as a “work for hire” wherein it is the employer (ie., studio, etc.) that is deemed the author and holds the copyright. Depending upon when the work was created, the duration of a copyright is currently the life of the author plus 70 years. “Anyone who violates any of the exclusive rights of the copyright owner ………… is an infringer of the copyright” in accordance with 17 U.S.C. § 501 (a). In order to prevail in a suit predicated upon the foregoing, one must establish/ prove similarity, viz., that the infringer actually copied the work and had access to the similar work. One way to establish proof of creation is to register the work with the copyright office (Form PA, plus copy of script, plus fee $20). One may also accomplish said goal (re: proof) by (registering)submitting a screenplay to the Writers Guild of America Registration Office.

Paparazzi

The topic, “paparazzi!”, apparently within the context of the Subject Matter, Privacy and Peace of Mind, seems, euphemistically speaking, oxymoronic. Indeed, the scenario concerning the paparazzi vis-à-vis Arnold Schwarzenegger shortly after he had undergone heart surgery was appalling, outrageous, and beyond the bounds of legality; that is, a criminal act. In balancing the equities, no countervailing argument of 1st Amendment considerations could change the aforesaid scenario given the outrageousness of the act of cutting off the Schwarzenegger vehicle as one typically expects as a modus operandi of other criminals during, ie., a theft, robbery, hit/murder, kidnapping, etc..

  • Dateline: 9-4-03 On this day, I believe not coincidental that I was on my way to Kinko's to make some copies for legal papers that were to be filed on 9-5-03 against 2 typical hispanic criminals, I was threatened and then assaulted by an hispanic who lay in wait as I walked down 3rd street, LA (the little niggeria, little liberia, little mexico section adjacent to little tokyo). An LAPD squad car was passing (though not the one dispatched) and I flagged it down. I gave the description of the perpetrator to LAPD Officers Todd and Velasco who took off in the direction of the perpetrator and with great retention and eye were able to spot the perp as he was about to board a bus, and by blocking the bus were ultimately able to make the arrest. It was great LAPD police work. The perpetrator was also a (prior) sex offender.
    More police are necessary, LAPD's budget should be increased from whatever source:
